All the groups and individuals ramshackle the Sadhu after giving him all the necessary assistance and realizing that he would move on his own. They had to move before the road was cleared by break up snow. Their need to get lynchpin their way before they could lose it justified their actions to abandon the Sadhu. The theory of categorical imperative was also obvious among all the groups and individuals. They all helped the Sadhu even when they could not benefit anything from their actions. However, they were influenced by the fact that they expected to be treated in a similar manner should they find themselves in a nee dy situation like that of the Sadhu.According to the theory of utilitarian, people should chose make a decision with maximum benefits and minimum harms when resolving ethical dilemmas. superstar of the New Zealanders identified the body of the Sadhu and did his best to take him down the mountain before he met McCoy. He dumped the body of the Sadhu before McCoy and resumed back to climbing the mountain with his friends (Jennings 6). That was the best he could do because he was supposed to cross the pass before sun could melt the ice. Ethical egoism is evident when Pasang refused to allow the porters to carry the Sadhu because they would not have enough energy to cross the pass after carrying the Sadhu to the hut. Pasang heavily relied on the porters to carry his luggage. The divine command theory is based on the idea that ethics is defined by religious beliefs. Immigration issues in the USA - Essay ExampleA estate without borders is not a nation and this country has been losing control of the borders for many decades, losing prosperity, security and autonomy along with them. The massive numbers of punishable aliens pouring across mainly the southern border has and continues to answer substantial economic, social and physical harms to legal citizens. These harms occur predominantly to those who are among the most vulnerable segments of the population minorities, children and the poor. Harms to the poor, minorities and children are indeed occurring but mainly to criminal aliens. An argument can be made if they should be afforded similar rights and protections as legal citizens but not if they deserve human rights considerations. Many at either level of government and in state and federal legislatures make water continu every(prenominal)y attempted to deny access to housing, schools, medical treatment and social programs to non-citizens. The federal government, to no ones surprise, has been no help. ... Genesis of the Issue The fundamental reason for the flood of immigration from Latin America, specifically Mexico, is the dissolving of the Mexican economy predominantly resulting from free-trade strategies employed by the North American Free Trade Agreement and the International Monetary Fund (IMF). The rampant decadency within the Mexican government has also contributed significantly to the collapse of the Mexican economy. Due to IMF policies regarding Mexico, its economic output dropped 33 percent in the past deuce decades. During this period, its foreign debt rose 359 percent because of widespread looting of the national coffers. These factors caused the collapse of all areas of productive economic activity and employment, is t he primary driver of the flood of emigrants larger-than-life to leave Mexico, to find some livelihood for themselves and their families in the United States 1 Amnesty, an Unpopular Concept Reward for Crime Throughout the history of America, people of differing ideologies have generally agreed on immigration controls. Public opinion polls have continually shown an overwhelming opposition to illegal immigration as intimately as for the concept of amnesty. The majority of Americans believe amnesty for illegal aliens is merely a reward for law-breaking and by whatever name, causes ever escalating future illegal immigration. No system depending on a strict regard for the rule of law can treat law-breaking so casually 2 Those who raise amnesty for illegal aliens, specifically those crossing the southern border do not seem to realize that a crime has been committed and not, as they mightiness have you believe, one without a victim. Lucy vs. Zehmer Essay Example | Topics and Well Written Essays - 1250 words

Lucy vs. Zehmer - Essay ExampleThe instrument the Lucys were seeking to enforce stated We hereby agree to administer to W.O. Lucy the Ferguson Farm complete for $50,000, title satisfactory to buyer. It was written by A.H. Zehmer, and was duly signed by both A.H. and I.S. Zehmer. The defense of A.H. Zehmer was that he considered the offer of Lucy to purchase Ferguson as a joke, and at the time they signed the document both of the respondents were drunk. Zehmer also stated that while he did write the document, to him it was more of a response to a dare, as he did non believe that Lucy could afford $50,000, something he outrightly told the latter. In fact, although Zehmer wrote the receive, he did not deliver it, but Lucy picked it up, read it and put it in his pocket. At this point, Lucy offered $5 earnest money to seal the contract, but realizing he was serious-minded, Zehmer refused to accept the money and instead told Lucy that had no intentions to sell Ferguson. On the otherwi se hand, Lucy contended that the sale was a done deal. He argued that at no time did he believe Zehmer to be joking. When Zehmer mentioned that Lucy would not be able to afford his price, Lucy assured him that he could. This was the causa Lucy immediately thereafter asked the help of his brother who agreed to share interests in the purchase. The raze court decided that Lucy had not proven his right to specific performance, and the sheath was dismissed. ... However, if the contract remains valid, then the Lucys are entitled to its specific performance. 3. The courts decision on those issues The Supreme Court of Virginia ruled that a valid contract had been created when the Zehmers pay off their signatures to the instrument, creating an obligation on either side to meet its terms as contained in the document. The claim of Zehmer that he was merely drunk, and at the same time notwithstanding joking (i.e., did not really intend to sell), is not sufficient to invalidate the existing contract. The complainants are entitled to the specific performance of the contested contract. The decision of the lower court is therefore reversed, and the case is remanded. 4. The rationale the court used in reaching those decisions The Supreme Court decided that Zehmers contention that he did not really intend to offer his property for sale does not hold water. It is true that normally, the law of contracts requires that the parties to the contract mutually consented to it. However, given certain cases such as this one, it is not so important for the parties to mentally agree to the forming of the contract what is important is that the acts and words of one of the parties convey the reasonable meaning of such intention to the other party, that is, that the parties appeared serious in their intent to transact (Patterson, p. 74). A binding contract of sale therefore existed between the two parties, whether or not the response of the Zehmers was serious or in jest, because one par ty (Lucy) made a serious offer, and took their response to be likewise a serious answer to his offer. Intentions of the parties to a contract are determined by a reasonable interpretation of their manifest conduct and expression. Unexpressed

The flashover was induced by horizontal ventilation, which happened within a very short span of time after the interruption of the window in the fire room. It must be noted that between the growth phase and the fully developed phase of a fire is what is cognise as flashoveroccurs when all the combustible materials in the room is ignited, simultaneously reaching their ignition temperatures up to 1000F (International Association of Fire Chiefs, Fundamentals 137). maculation LT Mickel and FF Begg had their experience and qualificat ions as firefighters with their full protective clothing, there was a problem on the way the whole team handled the training exercise. They failed to anticipate the potential fire behavior in the burn room due to miscalculations. The Office of the State Fire Marshall and NIST concluded that a flashover has occurred due to excessive fuel loads. The fire analysis conducted by NIST revealed that the gases were so fuel rich in the burn room that it took the fire seconds to mix with the oxygen and flashover (NIOSH 4).The fuel consisted of five wooden pallets, a bale of straw, and a twin-size urethane foam, which however been augmented by interior materials such as carpeting, foam urethane padding, hollow core closet doors, wood molding, wall-mounted head bestrides, and painted gypsum board on the walls and ceiling mattress resulting in flashover when the window was vented (NIOSH 3).In fine, the energy level produced by these fuel loads was far beyond the design capabilities of the victim s gears do it

Construction law - Essay ExampleSpelling out the rights and responsibilities of the various parties thus becomes very difficult, because the main weigh may exist between the guest and the contractor, but may not take into account the rights of the other third parties. It may not also adequately represent the rights of the client if there is a violation by the third parties in question.Collateral contracts are required in construction contracts, where subcontractors perform function for the main contractor rather than the customers themselves and their rights need incorporation into construction agreements. Collateral contracts in effect, establish a connection between parties such as the client and the subcontractors who would not otherwise enter into a direct contractual relationship. When a contractor expresses an intent to utilize the services of a particular subcontractor, who commences work on this basis, it will be empower to take legal action if the contractor fails to fulfi l any of the implied terms, even if no formal contract exists. Einstein for Aspergers Essay Example for Free

sensation for Aspergers Essaybrain a Case Study for Aspergers Christina Parker PSY 410 February 6, 2012 Dr. Melda Jones adept a Case Study for Aspergers Mental illness has existed as long as humans have, but only in the last hundred years or so have psychologist started to truly understand mental illness. There is still much, that is unknown about mental illness and human behavior. One mental unhinge that was added to the Diagnostic and Statistical Manual of Mental Disorders (DSM-IV) in 1994 is Aspergers Disorder. This disorder is usually diagnosed in early nipperhood, but in Albert Einsteins fourth dimension Aspergers Disorder was unknown.Einstein had many of the diagnostic criteria for Aspergers Disorder but was not diagnosed. Einstein was quiet and withdrawn, but had an amazing mind for mathematics. In comparison, Temple Grandin was diagnosed with Aspergers Disorder and has many of the same mannerisms as Einstein. Overview of Aspergers Disorders History Dr. Hans Asperger studied children that acted oppositely from others in the 1940s. Dr. Asperger called these children Little Professors beca travelout they were so interesting. In 1980s Dr. Lorna Wing called children with Aspergers (AS) high-functioning autism single(a)s.In 1994, the Diagnostic and Statistical Manual of Mental Disorders (DSM-IV) added AS. Aspergers Syndrome (ASD) is a distinct group of neurological conditions characterized by greater or lesser degrees of impairment in langu era and communication skills with repetitive or restrictive patterns of thoughts and behaviors. There is no known cause or treatment for AS. The parents of children with AS often by or before the childs third birthday sense that something is amiss in his or her childs behavior or developmental skills. Two out of 10,000 children statistically diagnosed with AS or ASD.Boys are three to four times more apt(predicate) than girls to have AS or ASD. The children exhibit slow up psychomotor skills (crawling and wal king), and have problems with communicating and socializing with other children. AS children have an obsession with one bailiwick or interests excluding other topics and interests. AS children have a formal speech that lacks rhythm and modulation. AS children appear clumsy when they walk and may have delayed motor skills (catching a ball, pedaling a bike, and other skills). The cause of AS or ASD is unknown but is thought to be genetic because AS tends to run in families. The part of the brain that controls social behavior functions differently or develops differently from other children without AS. The part of the brain that controls body movements and balance are also different in AS children than other children. ASD is a high-functioning autism disorder. Autism and Aspergers Syndrome Explained There is no known cause of autism. Research today is using MRI imaging to desexualize how the Autism brain is structured. Dr. Grandin explains her condition like this The brain is an offic e the frontal lobe is the office manager. The other compartments of the brain are like the many departments in an office. The office departments do not communicate well between the other offices such as sales, product development, management, and so on. The autistic brain has to be understood and trained in a way that works best for the individual. No one treatment works for every autistic individual. Finding what motivates the individuals fear and help the individual to overcome or change the environment to a less chaotic one will help the individual to learn and progress. Autistic individuals do not understand facial expressions or tone changes in voices.Behavioral issues such as defecation and twitching are common with Aspergers and Autism. Individuals with Aspergers Syndrome are high-end functioning Autistic individuals. To understand Autism and Aspergers Syndrome, Dr. Grandin suggests that citizenry move away from language. The nonverbal child does not understand language. The nonverbal child is sensory-based and has a complex disorder that is based on sights, sounds, smells, and touch. Cultivating the way the individuals method of thinking will prevent fear that causes anxieties will help the individual progress.Autistic individuals have high IQs and the ability to concentrate on one subject for a long time. Most autistic individuals are gifted in math, sciences, computers, tables, astrology, and other nonsocial areas that rely on thinking skills. A Look at Einstein and Grandin Albert Einstein Albert Einstein was born in 1879 to Hermann and Pauline Einstein (a middle-class German-Jewish family). Einstein scarcely spoke and was quiet more than backward as a young child. His sister remembers his concentration and ability to build pontifical houses and multiple storied levels of playing card houses. At age 4 or 5 Einstein marveled at how a magnetic compass prick invariably swung northward. This caused Einstein to conclude that something invisible was rum p everything sparking his interest in Physics at a young age. As late as age nine Einstein was hesitant to mouth, and did so pausing to select his words carefully. His parents feared that he was below average in intelligence. At the age of 12 Einsteins love for mathematics and natural philosophy was sparked by a booklet on Euclidian Plane Geometry. This booklet proved to Einstein that there was a clarity and authoritativety in theory and do an impression on him permanently.School depended on memorization and arbitrary authority of the teachers and faculty and was not conducive to Einsteins way of learning. At 15 Einstein quit school and moved to Italy with his family where his family was trying to start a business. He studied Mathematics, Physics, and Philosophy at home. His uncle, an engineer, and a medical student who ate with his family once a week are credited with stimulating Einsteins young mind. Was Einsteins brain different? Einstein died in 1955 and gave his brain to s cience.A pathologist named Thomas Harvey quickly preserved his brain, and made samples, and sections. Pathologists Harvey concluded that other than Einsteins brain seeming smaller than around brains, his was not unusual. Sandra F. Witelson and colleagues studied Einsteins brain again in 1999, and discovered that it lacked a wrinkle prime in other brains (the parietal operculum), and other regions on each side of Einsteins brain appeared to be larger and unusual features in the indifferent parietal lobes thought to be the area of visual imagery and mathematical thinking. This concludes that Einsteins brain was more equipped by this region than most individuals. Does this prove or disprove that Einstein had Aspergers? There is no conclusive historical evidence to determine if Einstein had Aspergers. What we do know is Einstein was capable of deep concentration, and had perseverance. He graduated without distinction, his learning style and the school learning system of his time did n ot get along. He sought physics because he could seek out paths that led to the depths. In other words Einstein preferred to be free to think on the invisible things behind things. It was Einsteins ability to think deeply on physics that put him first in the race to the theory in relativity. Einstein made friends with colleagues like Marcel Grossman, Michele Besso, Paul Ehrenfest, and Freidrich Adler. His wife Mileva Maric was the only female in his physics class. Even though Einstein renounced his German citizenship when he left Germany for Italy, he could not resist the invitation to Berlins Prussian Academy of Sciences, he had no teaching duties and access to the greatest scientific minds of his day. Fame in physics starved and undo his marriage to his wife Mileva, and then divorced in 1919.The same year of his divorce Einstein married his cousin whom he had an affair with since 1914 and settled with Elsa Lowenthal and her cardinal daughters until his death in 1955. Einstein as a young boy, a young teen, a young man, and an older man (Image The Albert Einstein Archives, The Jewish field University Library, The Hebrew University of Jerusalem, Israel. ) Temple Grandin Dr. Temple Grandin was thought to be different by her Mother from a very early age. At two Dr. Grandin could not speak and exhibited behavioral issues. Her Father and consulted doctors wanted to put Dr. Grandin in an institution. Dr.Grandins Mother would not have her daughter put in an institution. Instead, Dr. Grandins Mother move her daughter to private schools and to private speech therapy. Dr. Grandin was teased as a child in school. Dr. Temple states that early intervention is vital to best outcomes in autistic children. According to Dr. Grandin there are three types of Autism thinkers Visual, Pattern, and intelligence operation. Visual thinkers are terrible at algebra and good at geometry. Pattern thinkers have difficulty with reading. Word thinkers are good with facts in favorite su bjects. Dr. Grandin thinks in pictures, sees a series of slides like a search engine.During her lecture Dr. Grandin was tired from air travel and this caused her to get train of thought if movement or noises were made by audience. Dr. Grandin explained that she cannot screen out the sensory issues that trigger her distractions. Dr. Grandin admits to having timidity attacks, and anxiety. Anti-depressants help autistic individuals overcome anxiety, panic attacks, and OCD issues. Dr. Grandin correlates animal behaviors and fears with autism and how people handle animals also can be used to handle autistic individuals. When Dr. Grandin was born her parents were told she had infantile schizophrenia.Since her birth two Doctors one in the United States named Dr. Leo Canner and one in Canada named Dr. Asperger began get winding children who displayed certain characteristics no facial expression, lack of social skills, the ability to concentrate on one subject, and certain other emotional , cognitive, and behavioral components. Dr. Grandin was born in Boston, Mass. on August 29, 1947. Dr. Grandin has earned degrees from Franklin Pierce College, Arizona State University, University of Illinois, and has earned Honorary Doctorates from McGill University, University of Illinois, and Duke University. The United States and Canada Meat Plants use Dr. Grandins equipment designs developed for wight Welfare Guidelines. Dr. Grandins focus of study is in alleviating anxiety of intense fear and hypersensitivities to sound in Human and Animal populations. Dr. Grandin wrote autobiographies of her life with autism, which amazed the autistic community (Thinking in Pictures and Other Reports from My Life with Autism- 1995, and Emergence Labeled Autistic 1986). Dr. Grandin, has acquired many awards, lectures all over the United States, was inducted into the Cowgirl dorm room of Fame and is a member of the board of directors Autism Society of America.Dr. Grandin has developed her own website www. grandin. com to communicate with people on the subject of autism, and animal handling. Humane groups recognize Dr. Grandins work to alleviate animal fears, and her biography featured on HBO has won several Emmy Awards, a Golden Globe, and Peabody Award in 2011. Dr. Grandin has written several books, chapter books, journals, and other publications proving that people with Aspergers and Autism can succeed. Conclusion There is so much that humanity does not know about human behavior and mental illness, but psychological science continues to make advancements in the area.Aspergers Disorder is just one example of how psychology has advanced. In Einsteins time there was not a name for his weird quirks, but by the time Temple Grandin was born these similar quirks were known as Aspergers Disorder. Einstein was brilliant in mathematics and similar fields of study, but could not form true intimate bonds with other people. Dr. Grandin was also brilliant but in another area of stud y and she also cannot form true intimate bonds with people.
